Analysis of court practice on violation of EPR rules
Dmitry Bogdanov took part in preparing the issue of AEB Business Quarterly dedicated to producer responsibility matters.
The Code of Administrative Offenses of the Russian Federation provides for significant fines for violating the procedure for submitting reporting under the EPR (Extended Producer Responsibility) framework, as well as for non-payment of the environmental fee.
Producers and importers often have questions about the practice of imposing administrative liability in specific situations, as well as about the arguments that courts accept and those that, on the contrary, they reject when considering such cases and deciding on a specific fine amount.
Dmitry Bogdanov, Counsel at the Real Estate and Construction Practice at SL LEGAL, analyses the established judicial practice in his article.
